Terms of Use for Recipe Catch

Please read these Terms of Use ("Terms") carefully before using Recipe Catch ("the App"), operated by miraiapps UG (haftungsbeschränkt) ("we," "our," or "us").

By downloading, installing, or using Recipe Catch, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms supplement, and where in conflict take precedence over (as permitted by Apple), Apple's Standard End-User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula.

1. Acceptance of Terms

By using Recipe Catch, you confirm that you are at least 16 years of age (or the minimum age of digital consent in your jurisdiction) and agree to comply with these Terms.

2. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use Recipe Catch on Apple devices that you own or control, for your personal, non-commercial use, subject to these Terms and Apple's Media Services Terms and Conditions.

You may not:

• Copy, modify, or create derivative works of the App
• Reverse-engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, or sublicense the App
• Use the App for any unlawful purpose
• Remove or alter any proprietary notices in the App

3. No Account System

Recipe Catch does not require or offer user accounts. All content you create is stored locally on your device, under your sole control. We have no ability to access, recover, or restore your content — please keep your own backups if that matters to you.

4. Your Content

You retain full ownership of all recipes, notes, photos, and other content you create in Recipe Catch ("Your Content"). Because Your Content is stored only on your device, we obtain no license to it and have no access to it.

If you use the "Paste Link" feature to import a recipe from a third-party website, you are responsible for ensuring you have the right to import and use that content for your personal purposes, and for complying with the source website's own terms of use and any applicable copyright law.

You agree not to use Recipe Catch to store or process content that is illegal, infringes the rights of others, or contains malware.

5. Intellectual Property

Recipe Catch, including its design, source code, features, and branding, is owned by miraiapps UG (haftungsbeschränkt) and protected by copyright, trademark, and other intellectual property laws. This license does not grant you any ownership rights in the App itself.

6. Subscriptions and Purchases

Pricing

All prices are displayed in your local currency through the App Store and may change with notice; existing subscribers will be notified before any price change takes effect for their renewal.

Subscriptions

• The optional "Premium" subscription automatically renews unless cancelled at least 24 hours before the end of the current billing period.
• Payment is charged to your Apple ID account at confirmation of purchase and again at each renewal.
• You can view, manage, and cancel your subscription at any time in your Apple ID account settings, or via the "Manage Subscription" link in the App's Settings screen.

Refunds

All purchases are billed and processed by Apple. Refund requests must be submitted directly to Apple: reportaproblem.apple.com. We do not process refunds and have no ability to override Apple's billing.

Free Trials

If a free trial is offered, it automatically converts to a paid subscription unless cancelled before the trial ends. Trial eligibility is determined by Apple and is generally limited to one trial per Apple ID.

EU/EEA Statutory Right of Withdrawal

If you are a consumer in the EU/EEA, you generally have a 14-day right of withdrawal from a distance contract. By starting a paid subscription or a free trial that converts to paid, and gaining immediate access to Premium features, you expressly consent to immediate performance and acknowledge that your right of withdrawal is lost once the service has been fully performed — consistent with Apple's own purchase terms.

7. Availability and Changes to the App

We may add, change, or remove features at any time. We do not guarantee the App will always be available, error-free, or compatible with every device or OS version.

8. Termination

We may suspend or restrict access to features of the App if you violate these Terms. You may stop using the App at any time simply by deleting it — since there is no account, there is nothing further to "terminate" on our end.

9. Disclaimer of Warranties

RECIPE CATCH IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure; that imported recipe content will be accurate, complete, or safe to prepare (always use your own judgment, especially regarding food safety and allergens); that OCR text recognition will be free of transcription errors; or that data will not be lost.

Nothing in this section limits any statutory rights you have as a consumer that cannot lawfully be excluded, including under German or EU consumer protection law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MIRAIAPPS UG (HAFTUNGSBESCHRÄNKT) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF RECIPE CATCH, INCLUDING LOSS OF DATA CAUSED BY DEVICE LOSS, DAMAGE, OR DELETION OF THE APP.

Our total liability for all claims arising from or related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim, or €50, whichever is greater. This limitation does not apply to liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot be limited or excluded under German law.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of any mandatory consumer-protection rights under the law of your habitual residence.

Where legally permissible, the courts at the registered seat of miraiapps UG (haftungsbeschränkt) shall have exclusive jurisdiction over any dispute arising from these Terms. Consumers may also bring claims in the courts of their own place of residence within the EU.

The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr. We are not obligated and generally do not participate in dispute resolution proceedings before a consumer arbitration board.

12. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date above and, for material changes, notify you in-app before they take effect.
